These Terms & Conditions (“Terms”) apply to the use of the Everrental website and to bookings and vehicle rental services provided by Everrental (“Everrental”, “we”, “us” or “our”).
By using our website, making a booking or entering into a vehicle rental agreement with us, you agree to comply with these Terms.
Your individual rental agreement, booking confirmation and any applicable vehicle-specific terms may contain additional conditions that apply to your particular rental.

2. Eligibility to Rent
To rent a vehicle from Everrental, you must satisfy our applicable rental eligibility requirements.
These may include requirements relating to:
- Minimum driver age
- Valid driver’s licence
- Identification
- Proof of address
- Payment method
- Driver history
- Additional driver requirements
- Security deposit or bond
- Insurance or liability requirements
Specific eligibility requirements will be communicated before or at the time of booking.
You must provide accurate and complete information.
We may decline a rental where a customer does not satisfy applicable eligibility requirements or where we reasonably believe the rental cannot safely or lawfully proceed.
3. Driver’s Licence
The renter and all authorised drivers must hold a valid driver’s licence appropriate for the vehicle being rented.
You must provide your driver’s licence and any other identification requested by Everrental.
You must not allow an unauthorised person to drive the rental vehicle.
The renter remains responsible for ensuring that every person who drives the vehicle is properly authorised under the rental agreement.
4. Booking
A booking request does not necessarily guarantee that a vehicle is available until Everrental confirms the booking.
A booking may require:
- Customer identification
- Driver licence verification
- Payment or deposit
- Confirmation of rental dates
- Confirmation of vehicle availability
- Acceptance of the applicable rental terms
Once a booking has been confirmed, the booking confirmation and rental agreement will set out the applicable vehicle, rental period, price and other relevant conditions.
5. Vehicle Availability
Everrental will make reasonable efforts to provide the vehicle booked.
If the booked vehicle becomes unavailable because of circumstances including mechanical problems, damage, safety concerns or circumstances outside our reasonable control, we may offer a suitable alternative vehicle where reasonably possible.
If an appropriate alternative cannot be provided, we will discuss the available options with the customer.
6. Rental Period
The rental period begins and ends at the dates and times stated in the booking or rental agreement.
The vehicle must be returned:
- At the agreed time
- At the agreed location
- In the condition required under the rental agreement
- With the required fuel level
- With all keys, accessories and equipment supplied with the vehicle
Requests to extend a rental must be approved by Everrental before the original return time.
You must not assume that an extension has been approved until Everrental confirms it.
7. Rental Charges
The total rental price will depend on the vehicle, rental period and applicable services or options selected.
Charges may include, where applicable:
- Rental charges
- Optional extras
- Additional driver fees
- Delivery or collection charges
- Approved location fees
- Late return charges
- Cleaning charges
- Fuel charges
- Toll-related charges
- Traffic or infringement administration charges
- Damage-related amounts
- Other charges expressly disclosed in the rental agreement
Mandatory fees applicable to a rental will be disclosed as required by Australian Consumer Law.
Optional extras will be identified separately where applicable.
8. Security Deposit / Bond
Where Everrental requires a security deposit or bond, the amount and conditions will be disclosed before the rental is completed.
The security deposit may be used, where permitted by the rental agreement and applicable law, to cover amounts properly payable by the renter, such as:
- Damage for which the renter is liable
- Missing equipment or keys
- Excess cleaning costs
- Fuel charges
- Unpaid rental charges
- Approved fees
- Toll or infringement-related amounts
- Other amounts properly payable under the rental agreement
Any deductions will be handled in accordance with the rental agreement and applicable law.
Where applicable, Everrental will provide reasonable information supporting a charge.
9. Vehicle Condition
The renter should inspect the vehicle at the beginning of the rental and notify Everrental of any pre-existing damage or issues that have not already been recorded.
Customers are encouraged to take photographs of the vehicle before driving away and when returning it.
Everrental may maintain a vehicle condition report.
10. Use of the Vehicle
The rental vehicle must be used responsibly and lawfully.
Unless expressly authorised by Everrental, the vehicle must not be used:
- For unlawful purposes
- For racing, speed testing or similar activities
- For dangerous or reckless driving
- To carry prohibited goods
- To tow or carry loads outside the vehicle’s permitted capacity
- Off-road or on unsuitable roads
- In a way that may damage the vehicle
- By an unauthorised driver
- In breach of road laws or other applicable laws
The vehicle must be operated in accordance with manufacturer instructions and applicable Victorian and Australian road laws.
11. Prohibited Use
You must not use the vehicle in a manner that creates an unreasonable risk to people, property or the vehicle.
If you are unsure whether a particular use is permitted, you must contact Everrental before using the vehicle for that purpose.
12. Smoking and Cleaning
Smoking or vaping inside a vehicle is [PROHIBITED / SUBJECT TO YOUR POLICY].
Any cleaning or remediation charges will be applied only where permitted by the applicable rental agreement and law.
13. Pets and Animals
Pets or animals may only be carried in a vehicle where permitted by Everrental’s applicable vehicle and cleaning policy.
Assistance animals will be dealt with in accordance with applicable law.
14. Fuel
The vehicle will be supplied with a specified fuel level.
The renter must return the vehicle in accordance with the fuel requirements stated in the rental agreement.
If the required fuel level is not restored, an applicable fuel charge may be payable as disclosed in the rental agreement.
15. Kilometres / Distance
Where a rental includes a kilometre allowance or kilometre-related charge, the applicable allowance and rate will be stated in the booking or rental agreement.
Any additional distance charges will be calculated in accordance with the applicable rental agreement.
16. Tolls
The renter is responsible for tolls incurred during the rental where applicable.
Where Everrental receives a toll notice or related charge associated with the rental vehicle, the renter may be responsible for the toll and any disclosed administration charge permitted by the rental agreement and applicable law.
17. Traffic, Parking and Other Infringements
The renter is responsible for traffic, parking and other infringements incurred during the rental period to the extent permitted by law.
Where Everrental receives an infringement notice relating to the rental vehicle, we may provide the relevant renter information to the relevant authority where legally permitted or required.
Any applicable administration charge will be disclosed in the rental agreement.
18. Accidents, Damage and Breakdowns
If the vehicle is involved in an accident, damaged, stolen or becomes unsafe to drive, you must contact Everrental as soon as reasonably possible.
Where required, you should also contact the relevant emergency services or police.
You must not arrange major repairs without Everrental’s approval unless immediate action is reasonably necessary to protect people or prevent further damage.
The renter must cooperate with reasonable requests for information relating to an accident, damage, theft or other incident.
19. Damage and Liability
The renter’s liability for damage to the rental vehicle will depend on the rental agreement, any applicable damage liability arrangements and the circumstances of the incident.
Any exclusions, limitations, excesses or liability amounts applicable to the rental will be clearly stated in the applicable rental agreement.
The renter may remain responsible for loss or damage arising from circumstances excluded from applicable coverage or protection, where permitted by the rental agreement and law.
Everrental will not impose liability or charges contrary to applicable consumer law.
20. Insurance and Damage Protection
Where applicable, Everrental may provide or arrange insurance, liability protection or a damage reduction option.
The applicable rental agreement will specify:
- What is covered
- Applicable excess or liability
- Exclusions
- Conditions
- Customer responsibilities
Customers should read these provisions carefully before accepting the rental.
Nothing in these Terms removes rights that cannot lawfully be excluded.
21. Breakdown and Roadside Assistance
If the vehicle experiences a mechanical problem or breakdown, contact Everrental or the nominated roadside assistance provider as soon as reasonably possible.
Instructions provided by Everrental or the roadside assistance provider should be followed.
The specific roadside assistance arrangements applicable to your rental will be provided in your rental documentation.
22. Cancellation and Changes
Cancellation and booking-change conditions will be stated at the time of booking or in the applicable rental agreement.
Depending on the booking, charges may apply to cancellations or changes.
Any cancellation or change fee must be disclosed before the booking is accepted and must comply with applicable Australian Consumer Law.
23. Early Return
If you return the vehicle before the agreed end of the rental period, any refund or adjustment will depend on the applicable booking and rental terms.
Where a refund is available, it will be handled in accordance with the applicable terms and Australian Consumer Law.
24. Late Return
The vehicle must be returned at the agreed time.
If you expect to be late, contact Everrental as soon as possible.
Additional charges may apply where disclosed in the rental agreement.
A late return may also affect another customer’s booking, so customers must obtain approval before extending the rental period.
25. Vehicle Collection and Return
The customer must collect and return the vehicle at the location and time stated in the booking.
Alternative collection or return arrangements may be available subject to availability and any disclosed additional charge.
The vehicle must be returned with:
- All keys
- Supplied accessories
- Required documents
- Required fuel level
- No personal belongings
26. Personal Belongings
Customers are responsible for removing their personal belongings from the vehicle.
Everrental is not responsible for personal belongings left in a vehicle except to the extent liability cannot lawfully be excluded.
27. Privacy
Everrental collects and handles personal information in accordance with our Privacy Policy.
By providing personal information, you acknowledge that it may be collected and used for the purposes described in our Privacy Policy.
28. Website Information
We make reasonable efforts to ensure information on our website is accurate and up to date.
Vehicle availability, specifications, pricing and images may change.
Images may be representative and may not always show the exact vehicle supplied.
Where vehicle-specific information is important to your booking, the booking confirmation and rental agreement will take precedence over general website information, subject to applicable consumer guarantees.
29. Consumer Guarantees
Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee, warranty or condition that cannot lawfully be excluded under Australian law.
Australian Consumer Law provides consumers with certain automatic consumer guarantees when hiring a car. These include protections relating to the services supplied and the vehicle provided under the rental arrangement.
If Everrental fails to meet a consumer guarantee, the customer may have rights to a remedy depending on the circumstances.
30. No Unfair Contract Terms
These Terms are intended to operate consistently with applicable Australian Consumer Law.
Nothing in these Terms is intended to create an unfair contract term or deprive a customer of rights provided by law.
Australian Consumer Law protects consumers and eligible small businesses from unfair terms in standard-form contracts.
31. Limitation of Liability
To the maximum extent permitted by law, Everrental is not responsible for loss or damage that:
- Is caused by the customer’s breach of the rental agreement
- Results from unlawful or prohibited use of a vehicle
- Results from circumstances outside Everrental’s reasonable control
However, nothing in these Terms excludes liability that cannot lawfully be excluded or limits a customer’s rights under applicable consumer protection laws.
32. Events Outside Our Control
Everrental will not be responsible for delays or inability to provide services caused by circumstances outside our reasonable control.
These may include:
- Natural disasters
- Severe weather
- Road closures
- Government restrictions
- Major accidents
- Strikes
- Power or telecommunications failures
- Third-party service interruptions
- Other events beyond our reasonable control
Where such an event affects your booking, we will make reasonable efforts to communicate with you and provide available options.
33. Complaints and Disputes
If you have a concern about your rental, please contact Everrental first.
We will aim to investigate complaints fairly and respond within a reasonable period.
Nothing in this clause prevents you from exercising any rights available under Australian Consumer Law or other applicable legislation.
34. Governing Law
These Terms are governed by the laws applicable in Victoria, Australia.
Where appropriate, disputes will be subject to the courts and tribunals with jurisdiction in Victoria, subject to any mandatory consumer rights or dispute-resolution requirements that apply.
35. Changes to These Terms
Everrental may update these website Terms from time to time.
The updated version will be published on this website with a revised “Last updated” date.
The terms applicable to an existing rental will generally be those accepted as part of the applicable booking and rental agreement, subject to applicable law.
